The Fairness For Farmworkers Act:

• Entitles farmworkers to the state minimum wage of $15 an hour.

• Allows farmworkers to earn overtime after 55 hours when engaged in primary, or both primary and secondary agriculture.

  • Those engaged solely in secondary agriculture would be entitled to overtime after 40 hours. 

    • Supports farmers with these added costs by providing farmers with a refundable tax credit to offset a percent of the overtime they pay. 

• Provides farmworkers with the opportunity to earn up to 55-hours of paid-time-off yearly.  

• Entitles farmworkers to two paid breaks when they work 8+ hours a day.
